We are looking for a Legal Expert for Procurement Services.

Role of the DR/ABE/Procurement Service

Within the DR/ABE Unit, the Procurement Service is responsible for defining, implementing and enforcing procurement policies and procedures across the Agency and procure equipment, supplies and services contracted for the Agency, ensuring full compliance with the Contract Regulations, by providing the necessary procurement guidance to Agency managers, thereby enabling them to meet their business objectives, liaising closely with DR Business Partnering, helping define the optimal procurement approach, and facilitating the proper execution of the contracted terms and conditions.

JOB RESPONSIBILITIES

The successful candidate will be responsible for:
  • analysing procurement requests and providing guidance and advice on procurement procedures, and establishing specific purchase agreements or sales agreements in accordance with the EUROCONTROL Contract and Financial Regulations;
  • consulting suppliers in order to obtain the best prices and commercial conditions and ensuring acceptance of applicable general terms and conditions as well as other specific requirements;
  • negotiating and drafting contracts while obtaining the best legal guarantees, prices and commercial conditions;
  • preparing procurement and sales matters and presenting them at the Advisory Committee on Procurement and Sales Contracts and drafting the related minutes;
  • providing advice on procurement and sales matters especially in relation to legal, contractual, insurance and intellectual property rights aspects;
  • contributing to the improvement of existing purchasing practices by working on new solutions or recommendations concerning the updating/revision of the existing Contract Regulations, internal procedures and terms and conditions;
  • performing any other task in line with the main purpose of the job.

REQUIRED PROFILE

  • Master degree in Law or equivalent relevant working experience;
  • Minimum 1 year of relevant working experience;
  • Knowledge of public procurement rules and regulations would be an asset;
  • French and English writing skills: ability to write complex documents;

  • The working languages of the Agency are English and French. Thorough knowledge of one of the working languages of the Agency and satisfactory knowledge of the other language. For this particular position, an excellent knowledge of English is required.

  • An initial selection will be made by a Selection Board on the basis of the candidates' qualifications and experience. Thereafter, those candidates considered suitable may be invited for assessment and interviews;

Agency staff subject to the Staff Regulations governing officials, the General Conditions of Employment governing servants at the Maastricht Upper Area Control Centre, or the Conditions of Employment of Contract Staff are considered internal candidates. At the closing date of the notice of competition, internal candidates must have completed their probationary period;
  • This is an appointment for a determined period of 5 years pursuant to the provisions of the Staff Regulations. It could be extended up to a maximum of 7 years or converted into an undetermined contract. Before being established in the post, external candidates will be required to successfully service a probationary period of 9 months;
  • Internal candidates appointed to an established post or for an undetermined period:If successful, the person will maintain his/her current type of appointment yet be selected to fill the function of Procurement Expert under the conditions set above (determined period). At the end of this limited-term appointment, s/he will be transferred to the type of post and grade corresponding to the one s/he held before the appointment as Procurement Expert;
  • Internal candidates appointed for determined period:If successful, the person will be appointed for a new determined period;
  • The selected candidate will be appointed in principle at the basic grade of the advertised job bracket;
